Turkey Sports - Terms and Conditions All site and sport rules, notes and page content within this website is an extension of these terms and conditions and must be followed by any users of this website. If at any time you do not agree with any terms and conditions or content on this website please stop using the site and inform site administrators if you want your registration/membership cancelled. In these Terms & Conditions of Entry, unless the contrary intention appears, the following words and phrases have the meanings set out opposite them: "Sport" means the series of Matches of – (i) Australian Rules Football conducted by the Australian Football League (AFL) between member teams of the AFL over the AFL Season; or (ii) National Rugby League conducted by the National Rugby League (NRL) between member team so the NRL over the NRL Season. "Participant" means a person who is eligible to participate in the sport; "Fantasy" means the type of sport which consists of AFL Round Robin or AFL Play 4 Points; "Tipping" means the type of sport which consists of AFL Tipping or NRL Tipping; "League" means a group of 2 or more Participants who have linked their registrations online and who may, by using the tipping results of those Participants, conduct a separate non-commercial competition, the winner or winners of which may be eligible for prizes offered by the League’s Creator/Manager or other provider and which do not form part of the prizes offered by this web site; "League Creator" the creator of a league within a sport “Team” means a selection of Players that the Participant selects (afl fantasy); "Entry" means the league entry by the member; “Captain” means a (one) Player that a participant selects to receive double the number of Points (afl fantasy); "Match" means a single game, of and conducted by the relevant Sport, between member teams of that Sport (afl fantasy); or between 2 competing AFL or NRL teams during the atual 2008 season (tipping); "Tip" the selected NRL or AFL member team made in a tipping sport for a match in that sport "Player" means an registered player of the relevant Sport that has been made available on the website for selection and deemed to be available for selection for a Position within a team; (afl fantasy) “Points” means the value allocated to a Player for their Statistics in a given Match (afl fantasy); or the value allocated for tipping; (tipping) “Positions” means the allocated positions on the field that are available for selection, as outlined on the website. (afl fantasy) “Membership Date” means the date that a Participant registered on the Web Site. (afl fantasy) "Results" are the results of Matches as officially determined by the relevant Sport in accordance with the rules of that Sport following the completion of a Round; "Round" means a round of the relevant Sport conducted during that Sport's Season; “Season” means the 2008 season of a relevant Sport; "Score" means the sum of the Points of the Players in the Participant’s Team. (afl fantasy) “Statistics” means the personal on-field performance of individual Players from a Round of a Season; (afl fantasy) Web Site" means the Web Site of the Promoter at www.turkeysports.com.au accessible on the Internet through the World Wide Web. This web site is open to residents of Australia (and other countries where the law allows residents to enter promotions of this nature). Employees of the Turkey Sports and its agencies associated with this site and their immediate families are ineligible to enter. Entry is available for the following Sports, if applicable: (i) from on 01/03/07 and closes on 30/03/07 for the Fantasy sport; (ii) from on 01/03/07 and closes on 30/08/07 for the Tipping sport. To enter a particular Sport, a Participant must: a) register their details via the on-line registration form located on the Web Site; and b) If AFL Fantasy, create or join a league and register a team name, make a selection of the Players to be included in your Team, including the nomination of one player as a Captain each round, and submit that entry via the Web Site in the manner and within the time frames set out on the Web Site. c) If a AFL Tipping or NRL Tipping competition, enter a league by selecting either to create or join a league. A Participant must register their own personal details for participation in Turkey Sports. Turkey Sports however reserves the right not to accept for registration any Participant if the registration contains anything slanderous or defamatory or is otherwise unsightly, misleading or false in any way. (fantasy) In the event of a Match in a given Round being cancelled, abandoned, not completed or not played for any reason and/or a Result is not officially declared within three (3) days of the date the Match was originally schedule to be played, it is treated that the Players Statistics for that Match will be zero. (tipping) In the event of a Match in a given Round being cancelled, abandoned, not completed or not played for any reason and/or a Result is not officially declared within three (3) days of the date the Match was originally schedule to be played, it is treated that the tip selection was incorrect for that match. (afl fantasy) A Participant may make or change Captain and Player Selection for a given Round at any after the opening time of the previous round and in the time prior to the scheduled starting time of that Round within the sport rules of Turkey Sports. The sport will be closed/locaked at the beginning on the round stopping any further changes. (tipping) Tip selections for a round must be made before the beginning of that round. All away teams will be chosen for that entry if the Participant fails to make a tip selection. Once the round has begun the round will be locked and no further changes can be made for that round. Turkey Sports and its agencies associated with this web site are not liable and do not accept responsibility for: a) a Participant's team or tip selections that are not received or which are received and subsequently corrupted or rejected by the Web Site server, whether submitted by the Participant or by an administrator if in respect of a league participation. This explicitly includes any private or public competitions which use in any way or solely rely on the Web Site as a means for collection and disbursement of data to their participants; b) any lost, misdirected or corrupt emails to or from the Web Site; c) any loss or damage whatsoever (including but not limited to direct or consequential loss) or personal injury suffered or sustained: (d) in connection with a Participants participation in the Promotion or the taking of a place, except that which cannot be excluded by law; and (e) relating to the conduct of Turkey Sports however caused, including failure of the Web Site or incorrect or corrupt data supplied by the web site to Participant. Information about Participants is used by Turkey Sports to assess and process registration on Turkey Sports and in the Resort Rewards promotion. If an applicant does not provide the required information, the Turkey Sports cannot process the registration. All entries become the property of Turkey Sports and will be entered into a database. Information emanating from the Participant's participation in Turkey Sports is used by Turkey Sports, Resort Rewards and its agencies associated with Turkey Sports for the determination of winners and distribution of any prizes through the Resort Rewards promotion, if any, awarded to a Participant. Participants consent to publishing their name and accumulated winning team points in the results section of the Web Site. Turkey Sports will not be held responsible for any loss of reputation, status or otherwise in connection with a Participant's Team selections and consequential results. It is a condition of entry that Participants consent to these uses and disclosures of their information. Information about Participants may also be used by Turkey Sports, its agents, contractors and related companies, for the purposes of carrying out marketing, planning, product development and direct mail and promotional campaigns unless a Participant otherwise withdraws their consent to the use of their information in this manner. Notwithstanding Turkey Sports rights under condition ??? to not accept or to subsequently disqualify a Participant or Group, Turkey Sports will not be liable for any legal action arising out of any nick name, team name, league name, personal profile or website avatar being slanderous, defamatory or unsightly to the public at large or any similarly sounding or related group and any Participant who uses such content which is subsequently found to be slanderous, defamatory or unsightly in any way will indemnify Turkey Sports, its agents, contractors and related companies from any legal action, claim or dispute arising in relation thereto. In the event there is a dispute concerning the conduct of Turkey Sports, the decision of Turkey Sports is final and no correspondence will be entered into. Turkey Sports shall not be liable for any manufacturer defects in prizes or for any loss, damage or personal injury whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss) as a result of taking a prize, except for any liability which cannot be excluded by law. In the event of any unclaimed prizes within three months, prizes will be awarded to the 2nd ranked Participant, or third ranked Participant if that person fails to claim there prize and so on. Every attempt is made to ensure the statistics, game results or information posted on this site is of an accurate nature. However, this website is not responisble for incorrect information posted and it is recommended that users do their own research and inform Turkey Sports promptly if any issues are found. Registering and playing in any of Turkey Sports leagues is free. To receive Resort Rewards for playing on Turkey Sports you must be a fully paid member. The terms and conditions of the Resort Rewards promotion found on the Resort Rewards website (http://www.resortrewards.com.au/) are an extension to Turkey Sports Terms and Conditions and it is recommended that before becoming a fully paid member, users read and agree to those terms and conditions. Turkey Sports is not responsible for the promotion and products offered by Resort Rewards and members need to be aware of the terms and conditions on the Resort Rewards promotion. Fully Paid Membership is valid from 01/02/2008 to 30/09/2008 from which new membership must be taken up to earn rewards in any future sports. Fully Paid Membership must be made by 01/09/2008 from which no more memberships will be allowed until published on Turkey Sports for the next sport to be run on the web site. As a registered a user of Turkey Sports, you will earn non-eligible Resort Rewards for competing in any of the Turkey Sports leagues. These Resort Rewards are not valid for redemption. Once you become a fully paid member with Turkey Sports, any Resort Rewards accued will become eligiable for redemption. For members to earn extra resort rewards for getting a 1st, 2nd or 3rd placing in a league, the league must contain entries at least 8 fully paid members. Once you become a fully paid member, you will be given no refund under any circumstances. Any complaints or issues relating to Turkey Sports need to be made through the communication channels mentioned on this web site.   Turkey Sports - Privacy Policy This Privacy Policy applies to the activities of Turkey Sports BN20138118. They are provided on this website as a reference only and Turkey Sports recommends that you read the terms and conditions found at the Resort Rewards website for the most up to date version when joining the Turkey Sports Resort Reward promotion and also when redeeming and booking. Information on how to claim and redeem Resort Rewards Certificates, accommodation rates and booking information form part of these Terms and Conditions. Each Resort Rewards Certificate is provided by the participating Promoter (the business or other entity promoting the Resort Rewards Certificate) at its sole discretion, and only during the promotion dates determined by the Promoter. The Terms and Conditions relating to the promotion and redemption of each Resort Rewards Certificate are subject to change or withdrawal without notice. The validity dates of Resort Rewards Certificates are printed in the Terms and Conditions on the reverse of each Certificate. Each Resort Rewards Certificate can be applied as a partial payment only towards the published or discounted accommodation rates displayed on the website www.resortrewards.com.au or the RewardsCorp brochure “Resort Rewards” for a stay in a room or apartment at a selection of participating resorts for a stay subject to booking and availability. Prices and the information contained on the website www.resortrewards.com.au and the RewardsCorp brochure, “Resort Rewards” are subject to change without notice. The number of nights that you can stay at each resort will vary, depending on the resort selected. The total amount of your Resort Rewards Certificate(s) that can be applied towards an accommodation booking is dependent on the resort selected, its location, the type of room selected and the number of nights selected. You will be required to pay the amount that remains outstanding in relation to each accommodation booking. Information in relation to the amount of your Resort Rewards Certificate(s) that can be applied towards your accommodation and the amounts outstanding that will be payable is available at www.resortrewards.com.au. Rates for international resorts are subject to exchange rate fluctuations. All accommodation bookings and enquiries must be made through RewardsCorp on 1300 66 24 22 or online at www.resortrewards.com.au. Where the value of the accommodation that may be redeemed using a Resort Rewards Certificate is less than the total value of the Resort Rewards Certificate, the unused portion of the Certificate will be provided to you as a Credit Certificate for that amount, and can be used for future Resort Rewards bookings. A Credit Certificate is subject to the same terms and conditions as a Resort Rewards Certificate. A Resort Rewards Certificate cannot be used in conjunction with any other offer or promotion available through RewardsCorp and the participating hotels and resorts. A Hotel Room, Suite or 1 Bedroom Apartment sleeps 2 guests, a 2 Bedroom Suite or Apartment sleeps 4 guests, a 3 Bedroom Apartment or Villa sleeps 6 guests, and a 4 Bedroom Villa sleeps 8 guests, unless stated otherwise. Rates for 7 night stays at many resorts are based on Friday check-in. Alternative check-in days for 7 night stays may be possible subject to availability. A surcharge may apply. Your accommodation payment is required upon confirmation of your requested resort accommodation and booking dates. This is the amount specified on the accommodation price chart under each resort listing minus the amount redeemable using your Resort Rewards Certificate(s). Payment can be made by cheque, money order, bank transfer or with the following credit cards — Visa, MasterCard, (a 2.5% credit card surcharge will apply) or Diners Club (a 3% credit card surcharge will apply). With payment by cheque, bookings can only be confirmed upon receipt of cleared funds. The participating properties in this Promotion are generally available between 8 and 9 months of each calendar year. Resort availability is restricted, excluded or surcharged during most school holidays and the weeks immediately preceding and following these holidays. Public holidays, special events and other peak season periods are generally excluded. However, restrictions and exclusions are determined by the resort. Call RewardsCorp on 1300 66 24 22 with your preferences for up-to-date resort availably and recommendations. All requested booking dates are subject to promotion availability. Should you cancel your accommodation booking after full payment is made, no refund applies. However, you can amend your booking dates for your selected resort as often as you require, up to 35 days prior to your booked arrival date and you can also transfer your accommodation booking to another party, without penalty or incurring amendment fees, only name amendments will be permitted within 35 days of arrival at your booked resort. No cancellations or amendments are permitted for “Last minute specials”. At the sole discretion of RewardsCorp, and subject to the booked resort and the specific room inventory being utilised for another booking, cancellations and date changes may be permitted within 35 days prior to your booked arrival date, subject to a $100 fee. RewardsCorp advises Resort Rewards Certificate holders to book as early as possible to avoid disappointment, as most participating resorts are very popular and promotional room allocations at some resorts are very limited. Acceptance of your booking is subject to each participating resort’s standard conditions of acceptance of guests including but not limited to conditions in relation to booking, occupancy, payment and checkout that apply at all times. In the event of war, terrorism, political or civil unrest, state of emergency or disaster, the Promoter and RewardsCorp reserve the right to cancel, terminate, modify or suspend the offer or individual Resort Rewards Certificates. You are responsible for all travel including airfares and/or transport to the relevant participating resort, spending money, mini bar, additional meals and any and all ancillary costs incurred in order to take advantage of your accommodation booking. The rates and information in promotional brochures and catalogues and the www.resortrewards.com.au website are correct at the time of publication. RewardsCorp reserves the right to amend rates and conditions or withdraw resorts without notice. The Promoter, RewardsCorp and the participating hotels, resorts and other suppliers shall not be liable for any loss or damage suffered as a result of your participation in Resort Rewards, except for any liability which cannot be excluded by law. Each Resort Rewards certificate is fully transferable to family, friends, work colleagues and personnel, but cannot be sold, scalped, auctioned, raffled, pledged, redeemed for cash, or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial arrangements with that third party. If any Resort Rewards Certificate has been obtained through any of these methods it will not be honoured. In the event of a situation whereby RewardsCorp or the resort cannot provide booked accommodation as previously confirmed, for whatever reason, RewardsCorp will undertake to relocate clients into an alternative resort of comparable grading at no expense to the client. Should there not be a resort of comparable grading in the vicinity of the original booking, it may be required to provide clients with a resort of a lesser grading. If this is the case, any reduction in costs will be refunded to the client. The alternatives offered are at RewardsCorp’s discretion. Should the client wish to choose a property of a standard other than offered under this condition, then the client will be required to pay any difference. By participating in this offer, unless otherwise advised by you, you consent to the information you provide to RewardsCorp being entered into a database and RewardsCorp may use this information in any media for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to you. All personal details of participants will be stored at RewardsCorp offices. As per the relevant Privacy Legislation, a request to access, update or correct any information should be directed to that office. This promotion is governed by and is to be construed under the laws of Queensland.
